General Terms and Conditions of Movie Park Germany GmbH for Internet Bookings with Tickets for Self-Printing
Article 1 – Scope of Application
These General Terms and Conditions of Movie Park Germany GmbH apply to the online sale of Movie Park Germany tickets by Movie Park Germany GmbH. They supplement the Park Regulations available on site and retrievable underhttp://www.movieparkgermany.de/en/park/service/park-regulations.html and the conditions of use of the individual attractions available at the relating attractions. Movie Park Germany GmbH does not accept any deviating terms and conditions of the Buyer, unless it has given its express consent to their applicability.

Buyer is the purchaser of the tickets.
Article 3 - Offer
Information that describes products or services which can be purchased on the website of Movie Park Germany GmbH is to be considered an unbinding offer for closing a contract. The offer to conclude a contract will be valid as long as it is presented on the website, unless it is explicitly mentioned otherwise.Movie Park Germany GmbH undertakes to accept the buyer’s purchase order under the conditions of the website. Movie Park Germany GmbH is entitled to withdraw from the contract due to writing, typing and calculating errors.
Article 4 – Contract Closure
To conclude a contract, buyers must comply with the steps specified below which are available in the languages German, English and Dutch.Step 1 “Purchase Online”
The Buyer chooses the good(s) and service(s), as well as their quantity in the online shop. For security reasons, it is not possible to order more than 8 tickets per order and account holder. In this case, please contact our Service Center!
Step 2 “Identification”
The Buyer identifies himself/herself by providing the following mandatory personal data: first name, name, email address (no prior registration required).
Step 3 “Summary and Provision of Offer by Buyer”
A summary of the purchase order will be displayed on the screen, including the following data: order number, sold product(s)/service(s), total price, address. The Buyer must accept the General Terms and Conditions for Internet Bookings, a hyperlink allows the terms and conditions to be read, downloaded and printed. The Buyer may either complete the order by clicking on the “Yes, I confirm my order” symbol or change it by clicking on the “back” symbol; this step allows Buyers to correct errors and to subsequently confirm the purchase order by clicking on the “Yes, I confirm my order” symbol. By clicking on the “Yes, I confirm my order”, the Buyer submits a binding offer wishing to purchase the contents of the Shopping basket.
Step 4 “Payment”
The Buyer must be the same person as the credit card owner/account holder (automatic comparison). The Buyer chooses the type of payment:
a) payment by credit card (Master or Visa);
b) immediate transfer via the service provider Sofortüberweisung.de;
c) Giropay.
Credit card payments are supported by 3-D Secure security methods verified by Visa and Mastercard Secure Code. To complete the order, the relating security inquiries must be confirmed during the order process when the relating instructions appear on the screen.
Step 5 “Purchase Confirmation Mail including Tickets“
The contract will be concluded when Ticketcounter B.V. as service provider of Movie Park Germany GmbH sends a purchase confirmation by email, such will be sent immediately after receipt of the order and the payment of the purchase price via the payment service provider Docdata N.V. Attached to such email will be the relating number of links to the ordered tickets. The confirmation is also evidence of the contract concluded and the contract terms for the Buyer.
Step 6 “Printing of Tickets and Ticket Conditions”
The customer must independently ensure that he/she prints the tickets in a readable manner and presents them at the entrance to the Park on the day of arrival. Tickets may not be deposited at the sales counter. The period of validity is shown on the ticket. Tickets may only be used once (apart from 2-day tickets). Ticket users must be identical to the orderer printed on the ticket and the account holder. Each visitor needs an individual ticket to be read in and devalued at the entrance to the Park.
Article 5 – Consent to Forwarding of Address
In the event of a non-payment by the credit card company or an objection to the credit card payment of Movie Park Germany GmbH, the Buyer instructs its bank identified by the bank code specified, to inform Ticketcounter B.V. and Docdata N.V., at the latter’s request, of the name and address of the Buyer to enable them to assert their claim against the Buyer.Article 6 – No Right to Withdraw of Buyer
In accordance with Art. 312 b, sec. 3 no. 6 BGB [German Civil Code] tickets are not subject to Art. 312b BGB (Distance Selling Act). Accordingly, the Buyer is not entitled to withdraw from the Contract.
Article 7 – Cancellation of Tickets by Movie Park Germany GmbH
If payments are subsequently cancelled by the Buyer or if objections are raised against the debiting of a credit card, or if other discrepancies are found during the ordering process, Movie Park Germany may cancel the tickets and refuse entry to the Park.Article 8 – Data Protection
Movie Park Germany GmbH shall be entitled to process all data relating to the business relationship with the Buyer by complying with the Bundesdatenschutzgesetz [German Data Protection Act] and all other applicable data protection provisions. Guidelines regarding conformity with the rules on the protection of privacy are explained in Privacy Policy of Movie Park Germany GmbH.Article 9 – Place of Fulfilment, Place of Jurisdiction and Legal System
The place of fulfilment for delivery and payment and the place of jurisdiction for contracts with merchants, legal entities under public law and special funds under public law shall be Bottrop; however, Movie Park Germany GmbH shall be entitled to sue at the registered office of or at the office of a branch of the Buyer.The laws of the Federal Republic of Germany shall apply in exclusion of the UN Sales Convention.
If one provision of these Terms and Conditions is or becomes ineffective, the validity of the remaining provisions shall remain unaffected.
